More About New Zealand Online Casinos
Since the summer of 2004, it has been against the law for online casinos to operate out of New Zealand and provide real money gaming to the country's citizens. That's because when the Gambling Act 2003 went into effect, it made online real money gaming legal only when supervised by the Totalizator Agency Board (TAB) or the New Zealand Lotteries Commission (NZLC). Thus far, neither agency has taken steps to offer state-sponsored casino games, though lottery tickets are able to be purchased over the internet. Since the law requires any gambling activity to be offset by a benefit to the community, it's not clear if there will be any expansion in this area in the near future.
Still, as with similar laws in other countries, the Gambling Act did not make it illegal for New Zealanders to play real money games on sites based outside the country, and the government's official position is that it is legal to do so. This position appears to come from two schools of thought: One is that laws prohibiting internet gaming would be difficult to enforce, and the other is that New Zealand law does not apply overseas. The second part means that it is the player's responsibility to obey the local laws of the country hosting an online casino, but since today's casinos are set up in places that allow them to legally exist, that is generally not a concern.
A more recent and interesting twist in New Zealand gaming law came from an interpretation of the portion of the Gambling Act that banned overseas real money gaming sites from advertising in the country. A federal judge ruled in 2010 that advertising free money online poker sites did not violate the law because of poker's unique status as a game of skill as well as chance. It's unlikely that this view will allow the same leeway for free money versions of online casinos to be advertised, but it does illustrate how many parts of the law regulating online gambling are up for debate.
What isn't a point of contention is that citizens of New Zealand can play at online casinos hosted elsewhere with no fear of legal repercussions. Most gaming sites will happily accept their business, with many processing transactions in New Zealand Dollars.
